This privacy policy is for Talent Systems India Private Limited, company identification number U74910GJ2010PTC083087, operating under the trading name [FastCast] (“we,” “us,” or “our”). Our registered office is at B: 1309-1314, Navratna Corporate Park, Near Ashok Vatika, Bopal Ambli Road, Ahmedabad – 380058. Talent Systems India Pvt. Ltd. is the data controller or data fiduciary and determines the purposes for processing your information.

FastCast is a service that connects performers with casting professionals for roles in theatre, television and film productions (Services) via our website (www.fastcast.com) and any associated mobile apps.

This Privacy Policy describes the types of personal data that we may collect when you interact with the Services and the Platform, how and why we collect, store, use, and/or share (“process”) your information, and your rights in relation to our processing of your information.

1. WHEN AND WHAT PERSONAL DATA DO WE COLLECT?

We collect personal data that we need to enable you to register on the Platform, interact with and use the Platform and/or Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us. We will collect this information when you:

  • Visit and interact with the Platform and/or Services
  • Sign-up to or use the Platform and/or Services
  • Purchase or subscribe to the Services
  • Book to attend an event
  • Complete a survey or feedback form
  • Provide feedback on the Platform and/or Services
  • Correspond with via social media
  • Contact us for a query, complaint, or other types of enquiries via phone, email, post or otherwise

WHAT PERSONAL DATA DO WE COLLECT?

We may collect and process the following data including personal data:

  • Date of birth
  • Address(es)

  • Education, training, experience and skills
  • Physical details such as height
  • Information/ documents to enable us to vet an application
  • Information/documents you provide to prove age and identity, including via secure digital verification services

  • Your login and password information for accessing the Platform

  • Information gathered through cookies and other technical information such as your browser or device type, or your IP address

Please note that the Services are promotional tools by design, to enable us to effectively provide the Services and for you to benefit from it. Your personal data included in your profile will be accessible by other users of the Services and/or the public. Therefore, you should never include any personal data on your profile that you would wish to remain private. However, please also keep in mind that the type and amount of information you provide can impact the visibility and searchability of your profile and impact your success rate in being contacted by casting professionals.

The Platform enables your access to your personal data along with the ability to manage it such as managing the privacy of your profile including who can access or view profile data. Our ability to effectively provide you the Services may depend on the completeness and accuracy of your information. Therefore, it is your responsibility to ensure that your information is correct and updated. You may also contact us at support@fastcast.com if you believe any of the information you have provided us is incorrect or incomplete.

Casting professionals who view your profile or contact you may seek additional personal data including sensitive personal data (described below). The information visible to casting professionals (and depending on your account’s privacy settings, the public) and information that you provide them directly when they interact with you, are outside of our control. We have no control over how these third parties may use or distribute your information. You acknowledge the risk inherent in providing your personal data and sensitive personal data and accept these risks.

SENSITIVE PERSONAL DATA

We do not process sensitive personal data. Sensitive personal data includes:

  • Physical, physiological and mental health condition
  • Sexual orientation
  • Medical records and history
  • Biometric information

We do not need sensitive personal data and urge you to be cautious about the information you provide. Please ensure that the information you provide to us, or to others via the Platform and/or Services does not include your sensitive personal data. However, casting professionals who contact you via our services may seek sensitive personal data from you. As stated above, information visible to casting professionals and information you provide to them directly, are outside our control and subject to inherent risks which you accept.

We may record certain information pertaining to your financial transactions when paying for the Services. However, such information will be retained only for our internal accounting and fraud prevention purposes and will not be shared with others except where we are required to provide this information under a legal requirement, which will typically be for law enforcement purposes or to enforce our legal and contractual rights.

PERSONAL DATA AUTOMATICALLY COLLECTED

In Short: Some information – such as your Internet Protocol (IP) address and/or browser and device characteristics – is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

2. HOW DO WE USE YOUR PERSONAL DATA?

In Short: We use your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal data for the following purposes:

  • To register you as a user on the Platform and to manage your user profile including recognising returning customers
  • To enable you to submit an application/apply for an advertised role
  • To provide you the Services and make your profile information available publicly, and searchable where applicable, to other users of the Services;
  • To enable posting of casting call listings;
  • Enable casting professionals to filter the list of talent based on matching with selected criteria;
  • Scheduling in-person and video auditions and interviews with selected talent via the Platform;
  • To verify your identity;
  • To provide you with important service communications relating to our products or Services and with alerts and notifications based on your preferences including via email and push notifications;
  • To answer/respond to your enquiries and complaints or otherwise communicate with you;
  • To process and share audio and visual content including self-tape and audition videos;
  • To vet your professional background when you are joining as a FastCast Subscriber;
  • To communicate with you regarding professional industry enquiries;
  • To assist in the creation and editing of audio and visual content;
  • To process payments and identify or prevent fraudulent transactions;
  • To provide you with access to specific search facilities;
  • Internal record keeping;
  • To improve our products and Services;
  • To develop, test, improve and personalise the Platforms, Services and products that we provide to you;
  • For training and monitoring purposes;
  • To notify you of other products and/or services that may be of interest to you (based on local law, we may do this with your consent. You can unsubscribe from these communications by managing notification settings within your account on the Platform or by writing to us at support@fastcast.com; and
  • To comply with any legal obligation such as to share data with law enforcement agencies.

LEGAL BASIS FOR PROCESSING

We comply with applicable data protection laws and are committed to protecting your personal data in accordance with:

  • Information Technology Act, 2000
  • The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011,
  • Digital Personal Data Protection Act, 2023 (upon full implementation)

We will process your personal data on these bases:

  • Consent: Where you have provided consent for processing
  • Contract performance: Processing necessary for providing our Services
  • Legal Obligation: Processing necessary for complying with applicable laws
  • Other legitimate purposes: Detecting and preventing fraud, to improve our services, and processing necessary for our business operations

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

We may need to share your personal data in the following situations:

  • We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • We may share your information with our affiliates, in which case we will require those affiliates to honour this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
  • We may share your information with our subcontractors and business partners to offer you certain products, services, or promotions, or to operationalise and deliver certain features of the Platform and/or Services
  • Technology companies such as cloud services providers who help us host and deliver our Platforms and the Services
  • Marketing and advertiser partners to improve and personalise our Platform and Services to you
  • Law enforcement agencies based on information requests that we are required to comply with, or to enforce our Terms and Conditions or to protect the rights, property, or safety of ourselves, our customers or other third parties

4. WHAT MEASURES DO WE USE TO PROTECT YOUR PERSONAL DATA?

We are committed to ensuring the security and confidentiality of your personal data. We implement a variety of technical and organisational measures to safeguard your information against unauthorised access, disclosure, modification or destruction, including:

  • Data encryption. We encrypt data both at rest and in transit using industry-standard encryption protocols. This helps protect your data from unauthorised access while stored on our servers and transmitted over networks.
  • Access controls. We maintain strict access controls to limit access to your personal data to authorised personnel only. This includes regular reviews of user permissions, logging of all access attempts, and investigation of all unsuccessful login attempts.
  • Secure authentication. We use secure authentication methods to authenticate and authorise access to the Platform, and to verify the identity of users and devices accessing our systems.
  • Data retention and destruction. We retain data only for as long as necessary as outlined in this policy and based on applicable laws and regulations. We have data retention and destruction policies and procedures in place to ensure that your data is securely disposed of when no longer needed.

  • Vendor due diligence. We vet our third-party service providers to ensure they maintain adequate security measures to protect your personal data. We also have contractual agreements in place with these providers that require them to comply with our data protection standards. We only provide the information they need to undertake the service they provide and ensure contractually that they can only use the information for a specific and defined purpose. We also require them to return or delete any information held when their services cease.

  • Incident response. We have an incident response plan in place to promptly detect, investigate and respond to any security incidents or data breaches. We will notify you and relevant authorities of any breaches, as required by law and in accordance with breach reporting timeframe obligations.

6. IS YOUR PERSONAL DATA TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in India, and your data is processed and stored within India’s jurisdiction. We comply with applicable Indian data protection laws including the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and are prepared to comply with the Digital Personal Data Protection Act, 2023 upon its full implementation.

If you are accessing our Services from outside, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal data (see “WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL DATA?” above), in and other countries. Any cross-border transfers will be conducted in strict compliance with legal requirements and with appropriate safeguards to protect your data.

7. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal data for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal data, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal data has been stored in backup archives), then we will securely store your personal data and isolate it from any further processing until deletion is possible.

Upon the expiration of a talent subscription, the profile may remain visible to casting users and will be designated as inactive to facilitate ongoing or future professional outreach and communication, or request that a talent re-subscribes.

8. DO WE COLLECT PERSONAL DATA FROM MINORS?

In Short: The Services are not available to minors and we do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18.

9. WHAT ARE YOUR RIGHTS AS A DATA PRINCIPAL?

In Short: You may access, update, correct or complete your data at any time using the means specified in this privacy policy. You may withdraw your consent to non-essential processing and also generally withdraw your consent to our processing of your data.

You have the following rights:

  • Right to Access: You can request information about the personal data we hold about you and how it is processed.
  • Right to Correction: You can request correction of inaccurate or incomplete personal data.
  • Right to Erasure: You can request deletion of your personal data in certain circumstances, including when it is no longer necessary for the purposes for which it was collected.
  • Deleting data within FastCast: You may also request deletion of your personal data directly within FastCast. Please note that whilst we will action your request promptly, there may be a short delay in fully processing your deletion request due to system performance requirements or legal and regulatory compliance obligations.
  • Right to Withdraw Consent: Where processing is based on consent, you can withdraw it at any time without affecting the lawfulness of processing before withdrawal.
  • Right to Grievance Redressal: You can raise grievances about our data processing practices through our Grievance Officer, whose details are given below.
  • Right to Nominate: You may nominate another individual to exercise your data protection rights on your behalf in the event of your death or incapacity – details on how to submit a nomination will be made available once the Digital Personal Data Protection Act, 2023 is fully implemented.

To exercise these rights, contact us at support@fastcast.com or our Grievance Officer at sahil.dalal@fastcast.com. We will respond within 30 days as required under applicable law.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal rights and/or comply with applicable legal requirements.

10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

11. DO WE MAKE UPDATES TO THIS POLICY?

In Short: Yes, we will update this policy as necessary to stay compliant with relevant laws.

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this Privacy Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.
